Acceptance
By creating an account, using an intake link, or otherwise using Heal-X Clinical, you agree to these Terms and to the Privacy Policy. If you accept on behalf of a practice, you confirm you have authority to bind it. A practice also accepts the Heal-X Clinical practice terms and Business Associate Agreement inside the product before using features that handle patient information.
The service
Heal-X Clinical is decision-support software that helps licensed practitioners gather patient information and prepare wellness plans and reports for their review. It is not intended to diagnose, treat, cure or prevent any disease, and it does not replace professional judgment. The clinician of record reviews and approves everything a patient receives.
Eligibility
Clinician accounts are for licensed healthcare practitioners and their authorized staff. Patients use Heal-X Clinical through a link or page provided by their practice. Some features are available only after a practice accepts additional terms or completes credentialing.
Accounts
Keep your sign-in credentials secure and tell us promptly about any unauthorized use. You are responsible for activity under your account. We may suspend access that breaks these Terms or the law.
Clinical responsibility
Suggestions, checks and drafts are information for the clinician, not medical advice to a patient. Clinicians are responsible for verifying information against authoritative sources, for their clinical decisions, and for obtaining any consents their practice and the law require. Statements about supplements have not been evaluated by the Food and Drug Administration. If you think you may be having a medical emergency, call your local emergency number (911 in the US).
Your content and data
Practices keep ownership of the content they create. You give us the rights needed to operate, secure and improve the service and to process information as described in the Privacy Policy and the Business Associate Agreement. You confirm you have the rights and consents needed for information you enter or upload.
Acceptable use
You agree not to:
Provide care you are not licensed or credentialed to provide, or enter information you have no authority to process.
Bypass safety checks, review steps or access controls, or interfere with the service.
Copy, scrape, resell or reverse-engineer the service or its reference data, or use it to build a competing product.
Third-party services
Some features connect to services you choose, such as your Google Workspace account for sending email. Those services are governed by their own terms; you can disconnect them at any time.
Term and termination
You may stop using the service at any time. We may suspend or end access for breach of these Terms or as the law requires. On termination, practice data is handled as described in the practice agreement and the Business Associate Agreement.
Disclaimers and liability
The service is provided "as is" to the extent the law allows. To the extent the law allows, Heal-X is not liable for indirect or consequential losses, and its total liability is limited as set out in the practice agreement.
Changes
We may update these Terms. We will post changes here with a new version date and ask practices to accept material changes before they apply.
